Terms of Service (TOS)

These Terms of Service (“Terms”) govern your use of Switch Mobile’s wireless services, website, and related programs. By activating or using any Switch Mobile service, you agree to these Terms.

1. Service Overview

Switch Mobile provides wireless telecommunications services as a Mobile Virtual Network Operator (MVNO).
We use the network infrastructure of major carriers to deliver reliable voice, text, and data coverage.
Your plan, usage, and participation in any referral or giveback program are subject to these Terms.

2. Eligibility and Account Registration

To open an account or activate a line, you must:

  • Be at least 18 years old
  • Provide accurate, current, and complete information
  • Agree to all applicable payment and service terms

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

3. Plans and Billing

a. Service Plans

We currently offer two core plans:

  • Unlimited Plan: $50/month, all taxes and fees included
  • Pay-as-You-Go Plan: $25/month, limited data access

All plans are prepaid unless otherwise stated. Plan details and pricing may change, but you will be notified in advance.

b. Billing and Payments

  • Payments are processed securely via Stripe or other approved providers.
  • Payments must be made before your monthly renewal date to avoid service interruption.
  • If payment fails, service may be suspended until the balance is paid.
  • We do not issue prorated refunds for partial months or early cancellations.

4. Device Financing (If Offered)

Switch Mobile may offer device financing through approved investors or partners.
If you participate in device financing:

  • You agree to the financing terms presented at the time of purchase.
  • Devices may be network-locked until fully paid.
  • Defaulting on payments may result in service suspension or device deactivation.
  • Switch Mobile reserves the right to use third-party financing providers and share necessary account information to manage payments.

5. Referral Program

Switch Mobile offers a referral program where active customers can earn $4 per month per active line they refer.

Key terms:

  • Referral payments are recurring while the referred line remains active.
  • 13 active referrals qualify you for a free unlimited plan.
  • Referral earnings are non-transferable and subject to verification.
  • Fraudulent referrals or misuse of the program will result in disqualification and potential account termination.

6. Acceptable Use Policy

You agree to use Switch Mobile services lawfully and responsibly.
You may not:

  • Use the network for illegal or harmful activities
  • Engage in fraud, spamming, or network abuse
  • Resell or redistribute your plan or data without authorization
  • Use automated systems to artificially generate traffic

Violation of this policy may result in immediate service suspension.

7. Service Availability and Limitations

Wireless service availability may vary based on location, coverage area, and network conditions.
We do not guarantee uninterrupted or error-free service.
Temporary outages may occur due to maintenance, upgrades, or network provider issues.

Switch Mobile is not liable for any losses due to service interruptions, coverage limitations, or delays.

8. Returns and Refunds

Physical products (such as SIM cards or devices) may be eligible for return under specific conditions:

  • SIM cards: Refundable only if unused and returned within 14 days of purchase.
  • Devices: Subject to manufacturer warranty and applicable return policies.
  • Service fees: Non-refundable once activated.

9. Intellectual Property

All Switch Mobile trademarks, logos, and website content are the property of Switch Mobile, LLC.
You may not copy, reproduce, or use our materials for commercial purposes without written consent.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Switch Mobile shall not be liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the amount paid for services in the three months preceding the claim.

Some jurisdictions do not allow such limitations, so these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Switch Mobile, LLC and its affiliates, officers, employees, and agents from any claims, losses, damages, or expenses arising out of your use of the service or violation of these Terms.

12. Governing Law

These Terms are governed by and construed under the laws of the State of Utah, without regard to its conflict-of-law principles.

13. Changes to These Terms

We may update or modify these Terms periodically.
When changes are made, we will update the “Last Updated” date and notify customers via email or website notice.
Continued use of the service after changes constitutes acceptance of the revised Terms.
